Nebraska Fireworks State Law

Additionally, it is illegal to set off fireworks within 600 feet of any occupied dwelling or structure without the owner's permission.

It is unlawful for anyone to sell, loan, give away, or otherwise dispose of fireworks to others under 18 years. Possession of fireworks by anyone under 18 is also unlawful unless accompanied by an adult.

Any person who violates any provision of this section shall be guilty of a Class III misdemeanor. This section's second or subsequent violation shall be a Class IIIA misdemeanor. Punishment: By imprisonment in the county jail for not more than one year or by a fine of not more than $500.

Third and Subsequent Offense: It is a Class IV felony punishable by imprisonment for not less than one year nor more than five years or by a fine of not less than $1,000 or more than $10,000.

It is unlawful for any person to discharge or cause to be discharged fireworks within the corporate limits of any city or village in this state at any time other than between the hours of ten o'clock p.m. and one o'clock a.m. on the following days: December 31, January 1, the last day of February, the Fourth of July, Labor Day, and Memorial Day.

On New Year's Eve, fireworks may be discharged until one o'clock a.m. on January 1. The sale of fireworks is allowed from June 25 to July 3 and December 26 to January 1. All other days are restricted.
